Both of0:14those are 100% true right now. And that0:17means somebody somebody on Wall Street0:19is pocketing the spread. Guess what? I'm0:23going to show you why your escrow is0:25exploding while the exact collateral0:27risk everybody blames for it is actually0:30getting cheaper. I'm going to correct0:32five fake numbers currently being0:34repeated all over the financial media,0:36including the one that does not exist0:39anywhere on paper or otherwise. and I'm0:42going to give you the one word on your0:44escrow statement that decides whether0:46your serer has the legal authority to0:49demand a lumpsum wire in 30 days. This0:53may affect you, so you better pay close0:55attention. First, the part that is0:58completely real because this isn't a1:00fictional panic. It's a real crisis with1:02well, actually a fake villain when you1:05think about it. The leading mortgage1:08data benchmarks project that about 65%1:11of American homeowners with an escrow1:13account will hit a shortage this year.1:17The average shortage is sitting right1:18around 21,100 bucks. That forces an1:22out-of- pocket jump of roughly $1751:25more every single month. You want to pay1:28that? No. Well, you better pay1:30attention. Mortgage Servicing Desk uh1:32data shows that property insurance now1:35averages $29 a month on a standard loan.1:39That's an all-time high. It accounts for1:419.6% of the entire monthly mortgage1:44payment, and it has surged nearly 80%1:47higher since early 2020. Taxes and1:50insurance combined now eat up about 21%1:53of the total monthly payment across the1:56450 largest metro markets in America. In2:00nine states, it devours over 40% of the2:03payment. In places like Pensacola,2:05Florida, my god, it sits around 43%. And2:09look at the human toll. Recent2:11nationwide audits covering more than2:1314,000 mortgage borrowers found that 58%2:17of people with an escrow account saw2:19their payment climb this year. 30% of2:22all residential borrowers now believe2:25they're at serious risk of default or2:28foreclosure. Four years ago, that number2:31was just around well 17%. Meanwhile, a2:35recent consumer survey confirmed that2:3739% of homeowners still believed a fixed2:40rate mortgage payment could never2:42change. Well, they're about to be2:44surprised. It can, my friends. Your2:47interest rate, well, that's locked. The2:49cost of carrying the physical2:51collateral, that is not. Now, an honest2:55reality check here, right? The sub3%2:58mortgage is not as universal as the3:00headline suggests. Headline housing3:02metrics show that only 19.5% of3:05outstanding loans sit below 3%. So that3:09guy that keeps bragging about that3:10mortgage, well, he fits in a very, very3:14small group. And just under half, my3:16friends, sit only below 4%. So this3:19applies to roughly one in five of you,3:22not everybody. So let's get into it,3:25okay? But before we do, if you want the3:27raw desk truth on what moves your net3:29worth before the market figures it out,3:31well, you know where to figure it out.3:32Right here. Take some notes.3:44Correction number one, you may have seen3:46headlines screaming about a $420 billion3:50uh nationwide escrow shortfall. I went3:53looking for the original source of that3:55number. My friends,3:57it doesn't exist. No research note, no4:00academic paper, no banking regulator has4:04ever published an aggregate 14 billion,4:07$420 billion shortfall figure. I don't4:10know where it came from. What actually4:12happened though? Well, researchers4:15actually tallied up $396.84:18billion of total property taxes levied4:21on 89.6 6 million homes across America4:24last year. That's the entire annual tax4:27bill for every single family property uh4:30single family property in the nation.4:33Somebody grabbed that total levy,4:34rounded it up to 420 and relabeled it as4:38a consumer shortfall. Guys, it's a4:42phantom number. Really? Okay. Correction4:45number two. Property tax escrows did not4:48explode by 1,200 to 2500 bucks on4:51average. The actual national tax4:54assessor aggregate puts the average4:56annual tax bill at 4,4275:00bucks. That's up roughly 3%. The actual5:03average increase was $127 for the entire5:06year. The claims floating around the5:08internet are off by a factor of 10 to5:1220. And the popular explanation is5:14completely backwards. Assessors don't go5:17on an aggressive spree marking up5:19assessments to harvest revenue. Property5:22data shows average residential5:24transaction values are actually dipping.5:27They actually dipped by 1.7%.5:29Effective tax rates ticked higher5:31primarily because valuations cooled, not5:34because city hall went hunting for5:35money. Now there are brutal local5:38exceptions. Believe me, Memphis, I5:40think, saw something around as tax5:43assessment a jump of around 34%. Uh5:46Baltimore hit something like 27%. If you5:50live in those metros, this squeeze is5:52very real. And I know people from those5:55metro areas, but those are isolated5:58anomalies, not the national norm. So, if6:01it's not property taxes driving a6:02nationwide squeeze, it is insurance. And6:06here's the shadow data that point uh6:08shadow data point that nobody in the6:09mainstream press is talking about. Guys,6:12you know, I love the shadow data. Before6:14an insurance carrier writes a retail6:16homeowner's policy, it must ensure its6:19own balance sheet. That's called6:22reinsurance. It is the wholesale price6:24of catastrophic risk. Result it excuse6:28me. And it resets every January and6:31July. The global benchmark property cat6:34uh cat catastrophe index now is down 16%6:38this year. That's the sharpest annual6:40decline since the late 1990s. And from6:42its post-pandemic peak, that wholesale6:45index is down 23%. Mid-year renewals6:48across major in uh in uh institutional6:51brokers dropped by 20 to 25% pushing6:54wholesale pricing right back to where it6:57sat in 2021. That's right, 2021. The7:01wholesale cost of catastrophe collateral7:03risk has collapsed back to 2021 levels.7:06Yet, the insurance line on your monthly7:08mortgage statement just printed an7:11all-time high. That is not a natural7:14disaster. That is pure corporate margin7:18expansion.7:19Now, we know passing uh those savings7:21down is possible because, my friends,7:24we've seen it happen. Florida's7:26stateback uh residual carrier filed a uh7:292.6% rate uh decrease this year.7:33Louisiana cut 73,000 active homeowner7:37policies by 7 7.5% and state regulators7:41stated openly that the relief was driven7:43directly by plunging reinsurance costs.7:47In fact, Florida's residual pool has7:50shrunk 73% from its peak of 1.42 427:53million policies down to roughly just7:56385,000.7:58Now look at California and you get the8:01completely opposite script. I'm sure8:03you're not surprised to hear that. The8:05Cal the California Fair plan is hovering8:08near 700,000 policies up 157% in under8:13four years with a 29% rate hike landing8:16late this year. Same crisis totally8:20opposite directions. The driver is8:22regulatory policy, not meteorology.8:26Okay, now let's go for some more8:29corrections. Let's hit correction number8:31three. Everybody loves to blame inflated8:33construction costs, right? So, I went8:35straight to the producer price index.8:38Overall construction materials are up8:40about 24% since 2021. Not surprised,8:43right? Uh ready mix concrete uh is up8:4733%. Asphalt roofing is up 34%. Trade8:51labor is up 27%. But look at Softwood8:54Lumber. It's down 26% over that span and8:59sitting almost 50% below its record May9:022021 peak. The very first commodity9:05every pundit citation blames is9:07massively cheaper than it was 5 years9:11ago. Get that? Wow. Okay, let's go to9:14correction number four. There's a9:16popular narrative that servicesers are9:18hit with a liquidity run and raiding9:21borrowers accounts just to survive. The9:23actual regulatory filings unfortunately9:25disprove that claim. Major public9:28mortgage services are reporting9:29servicing advances down 33%9:33year-over-year. Advanced balances are9:35contracting. They're not surging. And9:37the servicing sector has consolidated9:40into massive balance sheet titans rather9:42than fragile brokers. Rocket Mortgage9:45completed its 14.2 billion purchase of9:48Mr. Cooper, now carrying over $29:51trillion in servicing across 9.1 million9:55loans. They have scale, not a cash run.9:59Correction number five, the narrative10:01that the Fed is actively crushing10:03consumers with endless hikes is well,10:05it's kind of stale. Benchmark overnight10:07rates sit pinned between 3.75% and 4%.10:10You should know this. and 30-year fixed10:12mortgages near 7.03% and rising sit10:16still well below the 779 peaks recorded10:20in late 2023, but they're climbing. We10:22can't ignore that. We're not remotely10:24near 1981, if you remember that I do,10:27when borrowing rates topped 18%.10:30What does this hardesque arithmetic10:33actually, my friends, mean for you?10:34Well, it means the baseline price shock10:37is pretty much baked in, but the10:39velocity of increases is slowing10:41dramatically. Annual insurance inflation10:44peaked at 15.1% in late 24 and has now10:48actually decelerated to 8.7%.10:52State approved rate filings dropped from10:5413.6% down to just 1.8% 8% recently and10:58fully 2third of the past year's premium11:00increase was driven by inflated policy11:03coverage limits, not by higher11:05underlying rates. Now, here's the exact11:09statutory playbook that you need to11:11protect your pocketbook. And most advice11:14on the internet, unfortunately, has it11:16kind of backwards. There is a critical11:19federal statute regulation X codified11:23under section 1024.17.11:26If your annual escrow analysis reveals a11:29shortage that is equal to or greater11:31than one full month of your normal11:33escrow payment, your serer has exactly11:36two legal options. They can either leave11:39the shortage alone or they can spread11:42the deficit over 12 equal months or11:44more. Demanding a forced wire in 30 days11:47is completely, my friends, completely11:50illegal under those conditions. But pay11:54careful attention to how the rule is11:55written. If the gap is less than one11:57month's payment, a 30-day cash demand,12:00well, weirdly enough, it's permissible.12:02And critically, you don't have the right12:04to demand a spread. The law strictly12:07restricts what the servicesers is12:09allowed to do. And here is the single12:12word on your statement that decides your12:15legal fate. Shortage versus deficiency.12:19A shortage means your balance sheet fell12:21below the statutory target. A deficiency12:24means the balance went negative and the12:27serer fronted hard cash. If your notice12:30states a deficiency, the serer only has12:33to offer two equal monthly payments. the12:3612-month mandatory spread protection.12:38Well, unfortunately, it disappears in12:40that case. So, the very first step is12:43looking at the header on your statement12:45to identify which word is printed in12:48black ink. Second, the two-month escrow12:52cushion. That statutory 16th of annual12:54dispersement is a legal maximum ceiling12:57a service provider is permitted to hold.12:59It is not a mandatory minimum that13:02they're forced to hoard. If your13:04underlying note or your state code13:06enforces a lower cushion, that lower13:08restriction controls. Okay. There's a13:11closing room down on Lower Broadway13:13where title reps shuffle loan closings.13:16I've sat at that desk. They slide a 2-in13:19stack of paper across the table with a13:21cup of really bad coffee and say,13:24"Initial here, please. The escrow13:26disclosure is sitting right around tab13:2914. In over 20 years on Wall Street,13:31I've never seen a borrower actually read13:34it. Oh, my wife probably read it,13:37though. Uh, that single page is the only13:39component of a fixed rate mortgage that13:41is never actually fixed. And now the13:45uncomfortable reality. All of these13:47borrower protections remain active13:49federal law today. But government13:52watchdog audits reveal a projected 88%13:54workforce draw down at the Consumer13:57Financial Protection Bureau. Guess what13:59that means? Supervisory capacity is down14:02nearly 90% reduced to just 50 people.14:05Just 50 people nationwide. Agency budget14:07caps were cut in half last summer.14:10Active enforcement actions have been14:11quietly dismissed and examinations well14:14severely curtailed. The regulation14:17remains on paper, but the cop well has14:19practically left the beat. So here is14:23your actionable desk playbook that I14:26love to give you. Step number one, audit14:28the wording. Verify whether your14:29statement uh says shortage or14:31deficiency. As I mentioned above, that14:33single designation dictates what your14:36serer can legally demand. Step number14:38two, reshop your hazard coverage.14:41Industry data confirms that borrowers or14:43switch carriers secured an average 6.6%14:46cost reduction, while those who rolled14:48over policies saw costs climb over 10%.14:52Adjusting a baseline deductible from 50014:55bucks to $2,500 commonly generates14:57around $51214:59in annual savings. But, and this is a15:03big butt, be careful. In 19 states, wind15:05and hail damage carries a separate15:07percentage based on deductible. A 2%15:10wind deductible on a $500,000 dwelling15:13is $10,000 out of pocket. Ouch. Make15:17sure adjusting a flat deductible15:18actually reduces the targeted hazard.15:21Okay, step number three. Don't get15:24blocked by dead underwriting rules. If15:26you're trying to refinance to clean up15:28debt, Fanny May's automatic desktop15:30underwriting ceiling extends up to 50 to15:34a 50%, excuse me, debt to income ratio.15:37The old 43% DTI limit was retired as a15:40qualified mortgage ceiling back in15:42October 2022.15:44Don't let a loan officer kill an15:46application with an obsolete rule book,15:50okay? and keep a very close eye on15:52wholesale reinsurance renewals this15:54coming January. If global catastrophe15:57rates drop for a fourth consecutive15:58cycle and your serer still expands your16:01monthly line, you'll know beyond a doubt16:03that you're paying for margin, not16:07meteorology. So, your truth bomb for16:09today is pretty simple. The wholesale16:12cost of catastrophe risk has collapsed16:14back to 2021 levels while the insurance16:17expense in your mortgage just printed an16:19all-time high. The spread between those16:22two numbers is not bad weather. It's16:24corporate profit and the statutory rules16:27protecting you from cashwire demands16:30remain fully on the books even if16:32nobody's left on the beat to enforce16:34them.
